No 'Terms of Service' policy could possibly cover every eventuality. Most people act responsibly and know what's right and wrong. However, we feel every one should know exactly what the terms are, and they are presented here for that purpose.

Internet Etiquette:

You are expected to be familiar with and practice good Internet etiquette (Netiquette). You shall not post, transmit, or permit Internet access to information; the content owner desires to keep confidential. You are not permitted to post any illegal, libelous, or indecent content/information likely to result in retaliation against us.

We reserves the right to determine if content violates this policy and reserves the right to refuse or terminate service at any time for violation.

Legal & Copyright Infringement:

NETFORCE network/servers may only be used for lawful purposes. Distribution, storage or transmission of any information, data or content in violation of rules, regulation and law, or by the common law, is prohibited. This includes, but not limited to, content protected by copyright, trademark or other intellectual property rights.

Unsolicited E-mail/SPAM:

Accounts caught sending unsolicited Emails or Usenet/Newsgroup postings, as defined by NETFORCE*, either through our servers or to promote a web site hosted on our servers will be suspended immediately, We reserves the right to investigate accounts accused of sending unsolicited Emails or Newsgroup postings, in any way deemed necessary. This includes terminating all hosting accounts of anyone having an account suspended for sending spam without notice.

Accounts terminated for sending unsolicited Email or Usenet/Newsgroup posts give up all rights to any domain names, website content, data, emails and backups stored on any and all our servers.

* Unsolicited E-mail or SPAM is defined, by NETFORCE as: E-mail sent to recipients who have not asked to be contacted by you or Usenet/Newsgroup postings, for the sole purpose of promoting a website, product /services or business through our servers.

We have a ZERO TOLERANCE POLICY on unsolicited emails or spam.

Adult/Pornography Sites:

Adult/Pornography sites and sex-related merchandising are prohibited on all our servers. This includes sites that may infer sexual content, banner ads, direct links or indirect links to content hosted elsewhere.

Network Security:

Web sites promoting, making available or otherwise contributing to violations of security including but are not limited to cracking, hacking, phishing, DOS (denial of service) attacks, DDOS (distributed denial of service) attacks, network flooding and any attempt to attack on our network/servers and/or using our servers to attack other network/servers will be removed from our servers without notice.

Violations of network security of any kind are strictly prohibited. Illegal acts will be reported and prosecuted.

Server Security:

You are responsible for maintaining the integrity of your login ID and password information. We does NOT recommend login ID/password sharing, emailing and/or saving online. You are solely responsible for protecting all Login information assigned to your account and for any authorized or unauthorized access and/or use of your account.

Violations of server security of any kind are strictly prohibited (All server activities are logged). Illegal acts will be reported and prosecuted.

Payment Default:

We reserve the right in its sole discretion, to suspend, terminate or remove the accounts if there is any default in your payment. A payment "default" means that you refuses to pay the invoice (for whatever reason), or the cheque/demand draft you send us is not honoured by the issuing bank or your credit card issuer bank denies the charge to your credit card account.

Accounts suspended or terminated for non payment or payment default of any kind give up all rights to any domain names, website content, data, emails and backups listed under the customer's (billing) account or hosted on any or all servers.

Account Termination:

1. Violation of our anti-spam policy will be grounds for immediate account termination.

2. Web sites deemed offensive, pornographic or racially degrading, at our sole discretion, will be removed from our servers without notice. Abusive behavior of any type will not be tolerated.

3. Web sites promoting, making available or otherwise contributing to software piracy, cracking, hacking, phishing, any attempt to attack on our network/servers and/or using our servers to attack other network/servers will be removed from our servers without notice.

4. Network Sniffers, IP Sniffers and/or Packet Sniffers of any type are not allowed, these are grounds for immediate account termination.

5. Internet Relay Chat (IRC) is not allowed on our servers.

6. Websites that mainly offer files for download such as mp3, videos etc. or used for an offsite file storage for any files are not allowed. Any websites with bandwidth usage or disk usage consisting mainly of downloads will be suspended or terminated.

7. Accounts using up enough server resources, to slow or crash a server, will be shut down without notice. A website with heavy traffic should not run BBS, webcams, forums and message board programs on our shared hosting accounts without our prior permission, due to the massive amount of server resources they require.

If an account is shut down, due to server resource issues, we will (upon request) make a reasonable effort to help get the account unsuspended. This includes tracking down the offending program, if applicable, and/or making available other arrangements for hosting the account on a VPS (Vitual Private Server) or Dedicated server (additional fees may be required).

8. Your account is for Web and Email use only, any other activity, at our sole discretion, will be grounds for termination.

9. Violation of any term of the TOS policy or inappropriate activity of any type on our network/servers, will be grounds for termination as well.

10. We reserve the right to suspend, terminate or remove the account if there is any default in your payment.

Domain Registration/Renewal:

We will make every effort to register and/or renew your requested domain name. This is not a guarantee that your requested domain name is available for registration and/or renewal. Your domain name may go unregistered and/or renewed, due to circumstances beyond our control, and will not be grounds for compensation of monetary loss. An order for domain name registration and/or renewal, does not guarantee domain name registration and/or renewal.

Domain names will NOT be registered and/or renewed until full payment is received.

Account Renewal:

The web hosting account is valid for the period that is paid for, in case, there is no renewal, any service provided by us will NOT be available to you. Any additional services purchased such as email address, storage space or sub domains are valid only till the time original account is valid.

We will make a reasonable effort to intimate you in advance on the renewal of the web hosting account that is due however it is NOT our responsibility to give you such intimations. The responsibility of renewing the account/service will entirely lie with you.

Diskspace / Bandwidth Overage:

If your hosting account goes over the diskspace/bandwidth allowance set for that account, you agree to pay for that overage and you must either upgrade your account or purchase additional diskspace/bandwidth. If you choose additional diskspace/bandwidth, you must purchase enough to cover the remaining term of your hosting account.

All diskspace/bandwidth/traffic are measured in MBytes/GBytes.

Downtime:

We will make every reasonable attempt to avoid unexpected network/server downtime and to ensure that all accounts are well taken care of. We cannot predict any network problem, outage or server downtime and is not covered under any guarantee or warranty and will not be grounds for reimbursement for any subsequent financial losses or damages.

IMPORTANT - Your Responsibilities Include:

1. You are solely responsible for the content of your website and emails.

2. All account data backups (even if we create and maintain your website) are the account holder's responsibility.

3. Protecting access to your account. This includes protecting your passwords, and any computers you use to access your account (FTP, Emails) if the password is saved on it or them.

4. Keeping your contact information with us (address, phone nos. etc.) up to date.

5. Checking the Terms of Service policy periodically to see whether a change has been made to this policy.


We reserve the right to amend the Terms of Service policy from time to time without notice to you. All accounts are required to comply with any changes made. Please check periodically to see whether a change has been made to this policy.
